海上丝绸之路经济带的建设促进了沿线国家的经济交往与合作,也可能伴生更多的跨国民商事纠纷。东盟作为海上丝绸之路合作的典型区域,与我国在政治、经济、文化等领域联系密切,但由于各国的司法体制和法治化水平的差异,仅诉诸传统区域间的司法协作方式,将难以获得便捷且有效的解决。为建构良性的海上丝绸之路民商事秩序,引入中国-东盟的多元化纠纷解决机制,全面打造海上丝绸之路多元化纠纷解决中心和中国-东盟线上纠纷解决机制,深化海上丝绸之路沿线国家区际司法合作和多元化纠纷解决机制的衔接,将是塑造“民心相通”的高效海上丝绸之路纠纷解决典范的中国方案。
<<The construction of the Maritime Silk Road Economic Belt has promoted robust economic exchanges and cooperation among ASEAN countries for their close ties with politics,economy,and culture,and may also be accompanied by more transnational civil and commercial disputes. Because of the limits of the differences in the judicial system and the level of rule of law in various countries,the dispute resolution will be difficult to implement by the traditional transnational judicial cooperation. Foresight in the construction of civil and commercial order for maritime Silk Road,introducing the China-ASEAN alternative disputes resolution system,building its online dispute resolution platform as well as modifying the connection of transnational judicial cooperation with ADR,will be a Chinese initiative of promoting a “people-to-people” exchange model for Maritime Silk Road Economic Belt.
