完善工资基准立法是构建符合社会主义市场经济体制运行要求的系统完备、科学规范、运行有效的工资分配制度体系的基础。本报告本着尊重历史、着眼现实、放眼长远、注意衔接的原则,提出了由劳动报酬定义、一般支付规定、加班工资支付、特殊情况下的工资支付、工资清偿、特殊群体劳动报酬支付基准、工资支付法律责任七个方面构成的工资基准立法框架,并就劳动报酬等十个重点专题提出立法建议,供有关部门参考和借鉴。
<<Improving the legislation of wage benchmark is the basis of constructing systematic,scientific and standardized and effective wage distribution systems that meet the requirements of the operation of the socialist market economic system. In this report,a legislative framework of wage benchmark consisting of seven aspects,including the definition of labor remuneration,general payment regulations,overtime wage payment,wage payment in special circumstances,wage repayment,remuneration payment benchmark for special groups and legal liability of wage payment is put forward based on the principles of respecting history,focusing on reality,taking a long-term view and paying attention to cohesion,and the legislative proposals on ten key topics,such as labor remuneration,have been put forward to provide reference for relevant departments.
