新技术的运用及其与生产要素的结合催生了新业态。新业态在给我们日常生活带来天翻地覆变化的同时,也引发了劳动者权益保障方面的新问题。以北京市为例,新业态下劳动者在用工关系、招聘方式、管理模式等方面存在新特点、新趋势。本文运用文献分析、对比分析等研究方法,横向对比北京各大快递运营机构在快递员权益保护方面的现状以及存在的问题,通过借鉴欧美等发达国家在劳动者权益保障方面的先进经验,分别从职业发展、生活关怀、立法、司法以及行政等多个方面提出加强快递员劳动权益保护的对策建议。
<<The application of new technology and its combination with production factors gave birth to the new business forms. While the new business format has brought earth shaking changes to our daily life,it has also triggered new problems in the protection of workers’ rights and interests. Taking Beijing as an example,there are new characteristics and trends in employment relations,recruitment methods and management modes. Using the research methods of literature analysis and comparative analysis,this paper compares the current situation and existing problems of major express operators in Beijing in terms of the rights and interests issues of couriers,and draws lessons from the developed countries such as Europe and the United States. This paper put forward suggestions to strengthen the protection of rights and interests of couriers from the aspects of professional development,life care,legislation Judicial and administrative aspects.
