黄河流域是中国仅次于长江流域的第二大流域,流域幅员广阔、地形多样、水情复杂,流域涉及地区社情多元,这使流域环境治理、生态保育和经济社会发展协调面临巨大挑战。为提升黄河流域生态保护和治理的系统性、整体性、协同性,黄河保护立法已被全国人大常委会列入2021年立法规划。作为一部针对特定流域制定的专门性立法,黄河保护立法应当针对黄河流域特有的生态环境问题,创设有效、具体、针对性的因应制度。黄河流域生态流量有限、水沙不协调、中上游支流水土流失严重、流域生态退化问题显著,且黄河流域沿线各省区发展相对滞后,结合这些生态环境特性和特殊社情,黄河保护立法应将流域管理体制、生态环境信息管理体制和流域生态保护补偿机制作为法律制度建设的重点。
<<The Yellow River basin is the second largest basin in China. This basin contains a capacious area,consist of multiple terrains,water regimens and social conditions,all of which make the environmental government,ecological preservation and the coordination of economic and social development quite difficult. In order to improve the systemic,holistic and synergistic nature of ecological protection and governance in the Yellow River basin,relevant legislation has been listed in the legislation project of 2021 by the Standing Committee of the National People’s Congress. The Yellow River Protection Act is especially for a particular river basin,so it shall establish specific regimes for the special problems in the Yellow River basin. In the Yellow River basin,the eco-flow is limited,water and soil erosion is quite serious on the upstream and midstream,and the ecological degradation of the whole basin is observable. These problems make the governing system,the environment information regime and the ecological protection compensation regime the key points in the Yellow River Protection Act.
