编纂教育法典,是完善教育法律体系、推进教育法治化的必然要求。当前,编纂教育法典既有必要性,也具备了可行性,围绕教育法典编纂,理论界开展了相关研究,取得了初步的成果,为法典编纂提供了学理支持。结合中国国情,教育法典的编纂宜采用统一立法的模式,在推进教育领域单行法不断完善的基础上,按照“先立总则、再立分则、最后统合”的思路,逐步形成统一的教育法典,为中国教育事业的高质量发展提供制度支撑和法治保障。
<<Compiling the educational code is an inevitable requirement for perfecting the educational legal system and promoting the legalization of education. At present,codifying educational code is both necessary and feasible. Around the codification of the educational code,the theoretical circle has carried out relevant research and achieved preliminary results,which provides theoretical support for the codification. Combined with China’s national conditions,the compilation of educational code should adopt the mode of unified legislation. On the basis of promoting the continuous improvement of special laws in the field of education,the unified education code should be gradually formed according to the idea of “establishing the general provisions first,then establishing the specific provisions,and finally integrating them”,so as to provide institutional support and legal guarantee for the high-quality development of education in China.
