    2015~2021年地方性法规结构特征研究——以成都市、广州市、杭州...

    摘要

    《立法法》修改以后,以往较大的市的立法权随之被限缩,整体法规结构的样态被重置。个案分析和对比分析能够快速掌握地方性法规结构的变动信息,从而了解地方立法的最新趋势。通过对我国东中西部四个设区的市的地方性法规结构特征和尚待提升之处的分析发现,城乡建设与管理成为各个城市的立法重点领域,但是四个城市各有侧重。成都市注重环保立法;杭州市立法理念较为先进,敢于尝试创新性立法;广州市和武汉市的促进型立法较为丰富。通过对法规内部结构的比较发现,成都市和武汉市法规结构具有显著关联性,与杭州市法规结构关联性最低。前者可以为成都市提供立法参照,后者可以为成都市提供立法创新思路。

    Abstract

    After the revision of the Legislative Law,the larger municipal legislative power was limited,and the overall legal structure was reset. Case analysis and comparative analysis can quickly grasp the change information of local regulatory structure,so as to understand the latest trends in local legislation. Through the analysis of the structural characteristics of local laws and regulations in the four districts locating in east,middle and west China and the problems still being upgraded,it is found that legislation about urban and rural construction and management have become the legislative focus areas of each city,but each of the four cities has its own emphasis. Chengdu pays attention to environmental protection legislation. Hangzhou city legislation concept is more advanced,which tries to explore innovative legislation. Guangzhou and Wuhan promotion-oriented legislation is more abundant. Through the comparison of the internal structure of regulations,it is concluded that the regulatory structure of Chengdu and Wuhan has significant correlation,and the correlatation of regulation structure with Hangzhou is the lowest. The former can provide legislative reference for Chengdu,while the latter can provide legislative innovation ideas for Chengdu.
