河长制在很大程度上破解了“九龙治水”的顽疾,但是囿于河段区域划分和分段包干考核局限,也存在短板。基于十年流域水质变化的实证分析得出表征,昭示流域治理的系统观以及流域治理立法意涵的生态文明指向。整个流域的跨区域政府合作、机构合作与协调都会受到局域、行政分割单元的牵制。流域治理需要确立系统观,基于科学的系统观是流域立法的应有意涵。关注流域的整体性、关联性、层次性、动态性、开放性等,是流域立法所指与能指。立法理念是确立系统观,立法路径是关键环节突破,立法落地保障是强化各级党政绿色发展责任。
<<The river chief system to the large extent has solved the stubborn disease of “Kowloon water control”,but due to the limitations of regional division and segmented assessment,there are also shortcomings. Based on the empirical analysis of the water quality changes of the ten years,it shows the systematic view of basin governance and the ecological civilization direction of basin governance legislation. Cross-regional government cooperation,institutional cooperation and coordination in the whole river basin will be contained by local areas and administrative division units. Basin management needs to establish system view,and scientific system view is the due meaning of river basin legislation. Paying attention to the integrity,relevance,hierarchy,dynamics and openness of the watershed is the meaning and ability of the watershed legislation. The concept of legislation is to establish a systematic view,the legislative path is a key breakthrough,and to ensure legislation is to strengthen the responsibility for green development of the Party and government at all levels.
