随着我国经济迈入新常态,推动营商环境的法治化理应成为各地方政府主导的方向。然而,区域经济发展不平衡所形成的“层级效应”,决定了政府实现由招商引资传统经济职能向优化营商环境经济职能的转化也将经历一个复杂而漫长的过程。政府借助招商引资进行区域间的交流与合作仍有必要,但应实现规范化。重庆的基本市情决定了其在通过立法优化营商环境的同时,也在积极推动招商引资的法治化。重庆在招商引资实践中暴露的招商政策不规范、招商体制不健全、招商引资考核导向不合理、招商规划引领不足等问题需要通过地方立法予以解决。重庆市进行地方立法应吸收云南省、贵州省、广西壮族自治区已经制定或者正在制定的招商引资地方性法规的经验与不足。本文在前期实地调研、立法资料分析、文献研读的基础上提出立法框架,以期对重庆市招商引资领域立法有所裨益。
<<As China enters the era of the new normal economy,promoting the rule of law of business environment should become the direction led by local governments. However,the “hierarchy effect” formed by the unbalanced regional economic development determines that it will be a complicated and long process for the government to realize the transformation from the traditional economic function of investment promotion to the economic function of optimizing business environment. It is still necessary for the government to carry out regional exchanges and cooperation with the help of investment attraction,but it should be regulated. Chongqing’s basic situation determines that Chongqing is actively promoting the rule of law of government investment promotion when it optimizes the business environment through legislation. The problems exposed by the practice of investment promotion in Chongqing,such as non-standard investment promotion policy,imperfect investment promotion system,unreasonable investment promotion assessment guidance and insufficient investment promotion planning guidance,need to be solved through local legislation. In the process of local legislation,Chongqing should absorb the experience and deficiency of Yunnan province,Guizhou province and Guangxi autonomous region in formulating local laws and regulations on investment promotion. The legislative framework which is proposed on the basis of preliminary empirical research,legislative data analysis and literature study is expected to be beneficial to the local legislation related to investment promotion in Chongqing.
