    2015年以来中国生态环境损害赔偿磋商制度完善研究

    摘要

    我国自实施生态环境损害赔偿制度以来,赔偿磋商制度得到了长足发展。在我国当前的生态环境治理实践当中也出现了一系列典型案例。这些案例的处理在很大程度上推动了生态环境损害赔偿磋商制度的发展,同时也暴露出存在的磋商程序启动条件、内容、磋商期限规范不完善,第三方主体参与磋商的实施方式不具体,磋商程序中信息公开与公众参与未充分落实,磋商程序与司法救济衔接不协调等缺陷。完善生态环境损害赔偿磋商制度,应当规范磋商范围、完善磋商程序,完善第三方作为磋商主体的制度规范,健全信息公开和公众参与制度,落实磋商程序与司法救济的衔接。

    Abstract

    Since the implementation of the eco-environmental damage compensation system in China,the compensation consultation system has made great progress. There are also a series of typical cases in the current practice of ecological environment management in China. The handling of these cases has largely promoted the development of the consultation system for compensation for ecological and environmental damage. At the same time,it also exposed that the starting conditions,contents and duration of the consultation procedures in the consultation system are not perfect,the implementation method of the participation of third-party subjects in the consultation is not specific,and the information disclosure and public participation in the consultation procedures are fully implemented,The lack of coordination between consultation procedure and judicial relief. In order to improve the consultation system of ecological environment damage compensation,we should standardize the scope of consultation,improve the consultation procedures,improve the institutional norms of the third party as the main body of consultation,improve the information disclosure and public participation system,and implement the connection between consultation procedures and judicial relief.
