In recent years，the construction of the rule of law in China has entered the “planning” era. Optimizing the business environment under various types of plans of the rule of law planning conforms to the theoretical model of modernizing the rule of law in late-developing countries，continues the historical experience of leading development with medium and long-term planning，and has ample practical foundation. In Henan Province，basic experience in optimizing the business environment under legal planning are as follows：following the “superior law” and adapting measures to local conditions，the planning system is systematically integrated，effective and efficient matching measures of legal planning. At a new starting point，to promoting the continuous optimization of the business environment with the help of the construction of a government under the rule of law. It is advisable to improve and promptly release the implementation plan for the construction of a government under the rule of law in Henan Province（version 2.0）under the guidance of the principles of according to “superior law”，starting from the reality of Henan，and strengthening matching measures.
