    2021年中国新时代教育督导治理现代化机制改革发展的法治检视

    摘要

    教育督导治理现代化机制改革发展的法治化理路,是新时代国家治理现代化与依法治国背景下教育督导管理模态走向的必然趋势。其本质在于强调破除教育督导传统管理形态的集权化和行政化,趋向法治化和行政民主化,特征呈现为多元主体共治型、民主协商型、依法以法督导和督导治理过程的高效能性。随着新时代教育督导治理结构主体越趋多元复杂,教育督导治理现代化机制改革发展需以法治理念作为理论基础,以法治规则进行支持与规导,用法治标准确保教育督导治理各主体的权利边界,强调依法以法督导贯彻教育督导治理活动的全过程。具体而言,一是健全与完善教育督导法律法规的顶层设计以保障有法可依,二是教育督导机构遵守依法以法督导的法治规定以保证有法必依,三是加强教育督导治理现代化机制运行过程中的执法监督,四是构建教育督导治理现代化机制的合力以营造良好环境。

    Abstract

    The legalization path of the reform and development of the educational supervision and governance modernization mechanism is the inevitable trend of the mode of education supervision and management under the background of the modernization of national governance and the rule of law in the new era. Its essence lies in emphasizing the centralization and administration of the traditional management form of educational supervision,tending to rule by law,de-administration and democratization,characterized by the high efficiency of multi-subject co-rule,democratic consultation,legal supervision and supervision of the governance process. With the new era of education supervision governance structure subject more and more diversified and complex,the reform and development of education supervision and governance modernization mechanism should take the concept of rule of law as the theoretical basis,the rule of law rules to support and guide,with the rule of law standards to ensure that education supervision and governance of the rights of the various subjects boundaries,emphasizing the legal supervision and implementation of the whole process of education supervision and governance activities. Specifically,the first is to improve and perfect the top-level design of educational supervision laws and regulations to ensure that there is a legal basis,the second is that educational supervision institutions abide by the rule of law provisions of legal supervision to ensure that there is law,the third is to strengthen the education supervision and governance modernization mechanism in the operation of law enforcement supervision,and the fourth is to build a modern mechanism of education supervision and governance to create a good environment.
