近年来,短视频版权侵权问题突出,各个短视频平台在版权治理工作上大多存在不足。平台一直沿用的治理模式在版权问题上显得疲软,国家几次对平台进行整治,也都无法整治版权问题的痼疾。通过分析短视频平台版权治理现状,可以发现平台与用户的行为互动逻辑造成了短视频平台版权治理困境:《用户协议》无法对用户行为做出约束,用户选择催生了版权侵权,短视频传播过程的各阶段参与者对版权的了解程度都不容乐观。以版权源头治理,短视频平台还需完善短视频版权事前审核制度,并扩充自身版权储备,以购买版权的行为让“知识有价”深入人心,最后再借助自身传播优势在全平台普及版权知识,提高全民版权保护素养,最终达到版权治理的目的。
<<In recent years,the short video copyright infringement problem is prominent,and most short video platforms are inadequate in copyright governance. The governance model that the platform has been following appears weak on the copyright issue,and the state has rectified the platform several times,but it is also unable to rectify the chronic problem of copyright. By analyzing the current situation of copyright governance of short video platforms,it can be found that the logic of interaction between the platform and users’ behavior has caused the copyright governance dilemma of short video platforms:the User Agreement cannot make constraints on users’ behavior;users’ choices have given rise to copyright infringement;and participants’ understanding of copyright at all stages of the short video dissemination process is not optimistic. With the source of copyright governance,short video platforms also need to improve the short video copyright prior audit system,and expand their own copyright reserves,and make the “knowledge has a price” deeply rooted in people’s hearts with the act of purchasing copyright,and finally popularize copyright knowledge on the whole platform with their own communication advantages,and push back copyright infringement with the improvement of national copyright protection literacy,so as to finally achieve the purpose of copyright governance.
