平台的隐私条款作为平台运营者与用户之间的协议,其存在与否、内容多寡、保障程度高低等均直接关系用户的信息权利受保障程度。本文选取72款网络购物类移动客户端,对其隐私条款进行量化分析。研究发现,网络购物类移动客户端隐私条款存在信息收集定义不清问题;信息处理存在“霸王条款”现象和模糊性术语;用户权利保障指引不规范,未有清晰的操作指示;未成年隐私保护内容形同虚设;境内外信息保护措施不够完善,但信息传达机制相对较为多元和畅通。未来在实践上应从完善网络隐私相关法律、健全App隐私条款内容、增强公民隐私保护意识等方面着手,加强隐私条款设定的实际效力。研究不仅对扩充隐私保护理论具有重要意义,而且对政府、网络运营者和用户提升其隐私保护意识具有极强的现实意义。
<<The privacy policy of the platform is an agreement between the platform operator and the user. Its existence,content,and degree of protection are directly related to the degree of protection of the user’s information rights. This article selects 72 online shopping mobile applications to quantitatively analyze their privacy policies. The research found that the privacy policies of online shopping mobile applications have unclear definitions of information collection;information processing has the phenomenon of “overlord policies” and vague terms;user rights protection guidelines are not standardized,and there are no clear operating instructions;privacy protection of minors the content is in vain;domestic and foreign information protection measures are not perfect,but the information transmission mechanism is relatively diverse and unobstructed. In the future,in practice,we should start from improving the relevant laws of online privacy,improving the content of App privacy policies,and enhancing citizens’ awareness of privacy protection to strengthen the actual effect of privacy policies. Research is not only of great significance for expanding the theory of privacy protection,but also of great practical significance for governments,network operators and users to enhance their awareness of privacy protection.
