    完善工资保障机制报告——基于2020年湖北省恩施州《保障农民工工资支...

    摘要

    《保障农民工工资支付条例》的颁布实施开启了依法保障农民工工资支付的法治时代。本报告通过对湖北省恩施州《保障农民工工资支付条例》实施情况的调查,了解到恩施州于2015年率先实施保障农民工工资支付“4+3”模式,《保障农民工工资支付条例》颁发后又改造升级了工程建设领域保障农民工工资支付管理信息系统,实施效果良好;分析了《保障农民工工资支付条例》实施的总体效果尚待提升等问题,及对市场经济条件下保障农民工工资支付的规律的认识尚待深化、制度体系尚待健全等原因,提出了构牢组织基础、夯实管理基础、强化制度基础、拧住制度“紧箍咒”、提升制度威慑力等健全农民工工资支付保障的对策建议,对修订完善《保障农民工工资支付条例》及地方制订实施办法具有重要借鉴价值。

    Abstract

    The promulgation and implementation of “the Regulations on Ensuring the Wage Payment of Migrant Workers” unfold the new era to ensure the wage payment of migrant workers by law. Through the investigation on the implementation of the Regulations in Enshi City,Hubei Province,it is learned that Enshi City took the lead in implementing the “4 + 3” mode to ensure the migrant workers’ wage payment in 2015. After the promulgation of the Regulations,Enshi City has upgraded the management information system for ensuring the wage payment of migrant workers in the field of project construction,achieving good implementation effect. This paper analyzes the problems that the overall effect of the Regulations implementation needs to be further improved,the reasons why the understanding and awareness on the law of ensuring the wage payment of migrant workers under the market economy condition needs to be deepened and the institutional system needs to be improved. The report also puts forward some countermeasure proposals to improve the mentioned wage payment guarantee system,including strengthening the organizational foundation,consolidating the management foundation,intensifying the institutional foundation,confining power within the institutional cage,and improving the deterrence of the Regulations,which has an important reference value for revising and improving the Regulations,as well as for local authorities to formulate the implementation measures.
