基于资源市场配置,逐步扩大土地有偿使用覆盖面、缩小划拨用地范围,是我国土地供应制度的发展趋势。PPP项目用地多数可以采用划拨方式供应,但对于其中的可经营性配套采用有偿使用已是大趋势。依法合理选择适合PPP项目特点的土地供应方式,是保障PPP项目顺利实施的重要基石。本报告在对PPP项目有偿供地的三种常见操作方式进行解析的基础上,提出实践中若采用PPP社会资本方招标与土地公开出让合并实施方式,应注意两个竞争环节的共性原则和流程差异,加强两部门间的工作协调配合,强化后期资产管理和资产移交筹划;若采用PPP项目国有土地租赁方式,应准确把握适用范围、规范选择交易方式、合理确定租赁期限、严格执行租金缴纳要求;若采用PPP项目国有土地使用权作价出资(入股)方式,应规范操作流程、科学评估确定国有资本出资额、依法确定政府出资人并明确其职责和权益、合理确定使用年限,以推动PPP项目顺利落地实施。
<<Based on the allocation of resources market,the trend of China’s land supply system is to gradually expand the coverage of compensatory land use and narrow the range of land allocation It is an important cornerstone to ensure the smooth implementation of PPP projects to choose the land supply mode suitable for the characteristics of PPP projects in accordance with regulations Most lands of the PPP projects are supplied by allocation,but it has been a general trend to adopt land compensatory use for the commercial operational supporting facilities Based on the analysis of the three common operational modes of compensatory land supply for PPP projects,this paper suggested that if combined implementation mode of PPP social capital bidding and land open transaction adopted in practice,one should pay attention to the common principles and process differences in the two competitive stages,and to strengthening the work coordination between the two departments,and the afterwards asset management and asset transfer planning If the state-owned land lease mode of PPP project is adopted,one should accurately grasp the scope of application,standardize transaction method,reasonably determine lease term,and strictly implement the rent payment requirements If the investment(shareholding)method by valuating PPP project state-owned land is adopted,one should standardize the operation process,scientifically evaluate and determine the amount of state-owned capital contribution,determine lawfully the government contributor and clarify its responsibilities,rights and interests,and reasonably determine the service life,so as to promote the smooth implementation of PPP projects.
