由于特定的国情和PPP制度的不完善,与西方主要国家PPP模式相比,我国PPP模式社会资本的主体资格存在一些问题。一方面,西方主要国家的社会资本以私营企业为主,我国则是国有企业成为社会资本的主力军;另一方面,实践中一些项目出现了将金融机构、基金优先级出资人作为社会资本采购的特殊案例。这些现象背后涉及社会资本的组织形式、所有制性质等形式标准,以及社会资本的核心能力与责任等实质标准等问题。本报告尝试从法解释学和西方经济学的理性人假设理论等视角,对这些热点问题进行回答。
<<Due to the specific national conditions and the imperfect PPP regulations,there are some problems with the subject qualification of social capital(private sector)in PPP model in China compared with which in major western countries. On the one hand,the “social capital” in major western countries are mainly private enterprises,while the state-owned enterprises have become the main forces of social capitals in China;on the other hand,there are several special cases where financial institutions or the priority investors of funds are selected as social capitals in government procurement in practice. These phenomena are related to the organizational forms and the nature of ownership and other formal standards of social capital,as well as the core capabilities and responsibilities and other substantive standards of social capital. This article attempts to answer these hot questions from the perspectives of legal hermeneutics and hypothesis of rational man of western economics.
