    深圳市政府投资建设项目法律风险及对策研究

    摘要

    投资既是政府发挥“看不见的手”的职责,对经济进行宏观调控的有力手段,也是政府引导和带动社会资金有效投向公共领域项目的有力抓手。近年来,深圳市级、区级政府年度投资总规模达到1500亿元左右,主要集中在基础设施、民生服务、生态文明建设、产业创新配套四大领域,其中“基础设施建设”领域一直独占鳌头,几乎每年都占据政府投资的一半。随着政府投资工程项目规模不断扩大,其可能存在的法律风险极易影响政府投资效率。本文以政府投资项目代建、工程变更、合同履行等政府投资项目管理过程中法律风险多发的问题为切入点,从法律角度进行分析,提出对策建议,以期运用法治思维和法治方式应对项目风险。

    Abstract

    Investment is not only the duty of the government as the “invisible hand”,a powerful tool to macro-control and regulate the economy,it is also a powerful means for the government to guide and drive social funds to effectively invest in projects of public area. In recent years,the total annual investment scale of municipal and district-level investment in Shenzhen has reached about 150 billion yuan,which is mainly concentrated in the four major areas,infrastructure,people’s livelihood services,ecological civilization construction,and industrial innovation support. Among them,“infrastructure construction” has always been the leader. Almost every year,it occupies “half of the government’s investment”. As the scale of government-invested engineering projects continues to expand,the possible legal risks can easily affect the efficiency of government investment. This article starts from the proliferation of legal risks in the management of government investment projects,such as construction of government investment projects,engineering changes,and contract performance,and analyzes from a legal perspective,and proposes countermeasures and suggestions,in order to use legal thinking and legal methods to deal with project risks.
