传染病防治向来依赖公共权力的运用,在新冠肺炎疫情暴发的紧急情况下更是如此。对法律来说,挑战在于,如何在授予政府必要权力与对这种权力保持反思品质之间寻求平衡。从本次新冠肺炎疫情防控来看,在新发传染病监测、纳入法定传染病管理前的即时控制等方面,法律赋予政府的权力与职责似不充分;将新发传染病纳入法定传染病管理的行政程序也缺少规范。与此同时,新冠肺炎疫情暴发后,在确保常态法制和非常态法制顺畅、规范地切换,为重大管制措施划定基本条件、范围和程序要求等方面,也有不少值得反思之处。为了提升传染病防治的法治水平,在未来修改《传染病防治法》时,需要进一步完善新发传染病的监测预警和报告制度,系统提升应对新发传染病风险的处置能力,进一步规范传染病种类划定的程序,进一步明确传染病管控中的法律适用,适度优化疫区宣布的措施。
<<The prevention and treatment of infectious diseases have always relied on the use of public power,especially in the emergency of epidemic outbreak. The challenge to legislation is to find a balance between granting the necessary power to government and maintaining the reflection on such power. In the prevention and control of COVID-19,the power and duty of government appointed by law seemed insufficient in terms of the monitoring of new infectious diseases,the immediate control before being included in the legal management,etc. It also lacks norms of the administrative procedures for the inclusion of new infectious diseases into the legal management. Besides,after the outbreak of the epidemic,there are also many shortages worthy of reflection,such as ensuring the smooth and standardized switch between the normal and abnormal legal systems,defining the basic conditions,scope and procedural requirements for major control measures,etc.. In order to enhance rule of law in the prevention and control of infectious diseases,measures shall be taken in the future amendment of Law on the Prevention and Treatment of Infectious Diseases. It is necessary to first further improve the monitoring and reporting system of new infectious diseases,secondly further standardize the control measures of emergency response and social activities as well as the procedures of defining the types of infectious diseases,thirdly further clarify the relationship between the two laws on the control of infectious diseases,and lastly further standardize the declaration of infected regions and restrictions on cross regional travel.
