    2020年关于加快制定《餐饮业发展促进条例》的研究报告

    摘要

    在应对新冠肺炎疫情的过程中,我国治理体系长期忽视餐饮业在国家公共卫生安全体系、社会公共健康体系以及国家应急保障体系中重要作用的问题被暴露。依法推进餐饮业高质量发展,将行得通、真管用、有效率的政策规章上升为法律,制定促进餐饮业发展条例,并将其纳入相关法律议程,依法推进改革,是餐饮业治理体系和治理能力现代化的现实要求。本文在分析加快制定《餐饮业发展促进条例》必要性和可行性的基础上,提出了立法路径,阐释了餐饮业发展促进条例体例结构和主要内容。

    Abstract

    In the process of responding to COVID-19,it has been exposed that China’s governance system has long neglected the important role of the catering industry in the national public health security system,social public health system and national emergency support system. To promote the high-quality development of the catering industry in accordance with the law,to elevate the policies and regulations that are feasible,effective and efficient into laws,to formulate regulations to promote the development of the catering industry and to put them on the relevant legal agenda to promote the reform in accordance with the law,are the practical requirements for the modernization of the governance system and governance capacity of the catering industry. Based on the analysis of the necessity and feasibility of speeding up the enactment of the Regulations on the Promotion of the Development of the Catering industry,this paper puts forward the legislative pathway and explains the structural arrangements and main contents of the Regulations on the Promotion of the Development of the Catering Industry.
