近年来,新就业形态在我国迅速发展。以平台就业为典型代表的新就业形态不同于标准就业形态和传统的非标准就业形态,对劳动关系认定、从业人员的劳动权益保障带来了巨大的挑战。为了应对这些挑战,我国正在对劳动用工政策进行改革,从时间上可以划分为两个主要改革阶段。目前主要有三个改革方向,具体包括单独的工伤保险制度改革、综合的劳动用工政策改革、企业主动承担社会责任改革。未来我国的劳动用工政策可在三个方面进一步完善,包括尝试构建一套保障平台就业者基本劳动权益的劳动基准体系、扩大社会保障制度的覆盖范围、对“掩盖劳动关系”给予坚决遏制。
<<New forms of employment have developed rapidly in China for recent years. Platform Employment,as one of the most important ones,is different from the standard form of employment and the traditional non-standard employment,and has brought great challenges to the identification of workers’ status and to the protection of workers’ rights. In order to cope with these challenges,China is reforming its labor and employment policies through two main stages. At present,there are three main trends:adjustment of the current industrial injury insurance system,comprehensive reform of labor and employment policies,and initiative of the corporation social responsibilities. In the future,China’s labor and employment policies can be further improved in three aspects,including the building of a set of labor standard system to protect fundamental labor rights,the expanding of social security system coverage,and resolutely fight against the disguised employment.
