党的十九大以来,中国自然资源监管在治理理念、体制机制、执法方式以及法治化等方面取得诸多进展,进一步统筹山水林田湖草系统治理,以生态化、整体性思维推进自然资源监管;推进自然资源产权改革并明确全民所有自然资源资产所有者、国土空间规划及用途管制和生态保护修复的机构及职责;以执法效果为导向,完善规划与审批机制,加强事中事后监管;相关立法的立、改、废加速等。中国自然资源监管在取得上述成效的同时,仍存在社会监管力量薄弱、自然产权及登记制度尚需平衡推进、自然资源监管执法及法律责任有待健全完善等问题,今后需推动企业及公众等多种主体参与自然资源监管,健全自然资源产权及相关登记制度,加强监管的程序、责任约束和保障机制建设。
<<Since the 19th National Congress of the Communist Party of China,China’s natural resources supervision and law enforcement has made substantial progress in the governance concept,system mechanism,law enforcement methods and legalization. Efforts have been made to coordinate the governance of landscape,forest,field,lake and grass system,to promote the natural resources supervision with ecological and holistic thinking,to advance the reform of natural resources property rights,clarify the institutions and responsibilities of the owners of natural resources assets owned by the whole people,land space planning and use control,and ecological protection and restoration. Guided by the effect of law enforcement,we have improved the planning and approval mechanism,strengthened the supervision during and after the event,and accelerated the establishment,modification and abolition of relevant legislation. While China’s natural resources supervision and law enforcement has achieved the above results,there are still some problems,such as weak social supervision,unbalanced development natural property rights and registration system,and imperfect natural resources supervision and law enforcement procedures and legal responsibility mechanism. In the future,it is necessary to promote enterprises and the public to participate in natural resources supervision and improve natural resources property rights and related registration system,strengthen the construction of supervision and law enforcement procedures,as well as responsibility constraints and guarantee mechanism.
