《人民陪审员法》对参审范围的规定较广,且参审机制具有强职权化的特征。人民陪审员参审范围设定过大不仅会浪费司法资源,也会导致制度功能错位和形式化。为有效发挥人民陪审员制度提高司法公信力、吸收普通人智慧的司法民主功能,立法上有必要适当限制人民陪审员的参审范围,以重大、复杂刑事案件为主,且以被告人、被害人提出申请为条件适用人民陪审员参审。限制人民陪审员参审范围有利于发挥司法民主功能,也有利于节约司法资源,降低区分事实与法律问题的难度。
<<The Law on People’s Assessors has broad regulations on the scope of participation in trials,and the participation mechanism has too much authoritative factors. Excessive scope of participation of people’s assessors will not only waste judicial resources,but also bring about the old problems of system function dislocation and formalization. In order to give full play to the judicial democracy function of the people’s assessors regime in improving the judicial integrity and absorbing the wisdom of ordinary people,it is necessary to limit the participation scope of people’s assessors in the trial. People’s assessors should participate in those major and complex criminal cases with the application from the defendant and the victim. Limiting the scope of people’s assessors’ participation in the trial is conducive to the exertion of judicial democracy function,saving judicial resources and reducing the difficulty of distinguishing facts from legal issues.
