黄河流域生态保护和高质量发展是一项重大国家战略,基层治理水平则是高质量发展的重要维度。黄河沿岸村镇与“黄河滩区”“黄河故道”“黄河湿地”等国土资源高度重叠而自成体系,近20年来其规划主题也历经“滩区建设”“精准扶贫”“特色小镇”“生态保护”的数次演变,与之相关的《预算法》、《招标投标法》、《城乡规划法》、《水法》和《环境保护法》等的制定与修订,勾勒出法治进程的清晰轮廓。随着郑州国家中心城市建设加速,黄河生态价值必将持续提升,基层治理作为法治进程的微观问题,其地位也必将更加凸显。围绕近年来黄河沿岸滩区建设项目的实施过程可以窥见一部浓缩的治水历史,当前法治与基层治理相互融合形成了新型的“水治文明”,其核心在于价值理念上的“从善如流”与体制机制上的“因势利导”。今后应以此为推手促进沿岸村镇群众达成“重叠共识”,构建法治的“软环境”并向“诱致性制度变迁”转换,为沿黄两岸的农村法治与基层治理提供样板。
<<Ecological protection and high-quality development of the Yellow River Basin is an important national strategy,while the level of grass-roots governance is an important dimension of high-quality development. The villages and towns along the Yellow River are highly overlapped with the land resources such as “Yellow River Beach Area”,“Old Road of Yellow River” and “Yellow River Wetland”,which are self-contained. In the past 20 years,their planning themes have also undergone several evolutions such as “beach area construction”,“precise poverty alleviation”,“characteristic towns” and “ecological protection”. Related Budget Law,Bidding Law,Urban and Rural Planning Law,Water Law,Environmental Protection Law and so on have been formulated and revised,which have drawn a clear outline of the rule of law process with the acceleration of Zhengzhou’s national central city construction,the ecological value of the Yellow River will continue to improve,and grass-roots governance as a microscopic problem in the process of rule of law will also become more prominent. Focusing on the implementation process of coastal construction projects in the Yellow River beach area in recent years,we can get a glimpse of a concentrated history of water control. At present,the integration of the rule of law and grass-roots governance has formed a new type of “water control civilization”,the core of which lies in the value concept of “following the good” and the institutional mechanism of “guiding according to the situation”. In the future,we should use this as a driving force to reach the “overlapping consensus” of the people in coastal villages and towns,build a “soft environment” for the rule of law,and initiate “induced” institutional changes and civilization progress,so as to provide a model for the rule of law and grass-roots governance in rural areas along the Yellow River.
