黄河流域生态保护和高质量发展目前已经成为重大国家战略。黄河的保护和治理一直是安邦兴民的大事。黄河是世界上最为复杂难治的河流之一,经过多年来的生态治理和修复,下游河流水质改善明显,但水污染治理实践成效仍不容乐观,生态修复问题、矛盾多,流域生态司法机制与跨区域、跨部门联动机制匮乏。要全面落实习近平生态文明思想,以司法体制改革入手,充分发挥政法和行政执法部门职能作用。成立专门审判监督机构,实现案件集中管辖;完善环境保护跨区域、跨部门管理协调、司法协作联动机制;优化环境监管执法方式,加强监测监控执法能力建设;鼓励社会参与、信息共享,促进涉水纠纷多元化解;适时推动《黄河保护法》立法。以上举措的实施能从根本上解决跨区域的黄河流域环境生态保护和污染治理问题,为黄河流域生态保护和高质量发展提供强有力的执法司法保障。
<<Ecological protection and high-quality development in the Yellow River Basin has become a major national strategy. The protection and management of the Yellow River has always been an important event for social stability and people’s happiness. The Yellow River is the most complicated and refractory river in the world. After years of ecological treatment and restoration,the water quality of the downstream river has been improved obviously. However,the practical results of water pollution treatment are still not optimistic. There are many contradictions in ecological restoration,and there is a lack of ecological judicial mechanism and cross-regional and cross-sectoral linkage mechanism in the basin. It is necessary to comprehensively drop the internship of General Secretary Xi Jinping’s Ecological Civilization Thought,start with the reform of the judicial system,give full play to the functions of political,legal and administrative law enforcement departments,improve the specialized trial supervision institutions,improve the centralized jurisdiction of cases,and improve the cross-regional and inter-departmental management coordination and judicial cooperation linkage mechanism of environmental protection. Social participation,information sharing,promote diversified solutions to wading disputes,promote the legislation of the Yellow River Protection Law in a timely manner,and fundamentally solve the problems of environmental ecological protection and pollution control in the Yellow River Basin across administrative regions.
