黄河流域自然保护地是我国重要的生态屏障,它们在保护生物多样性、保存自然遗产、改善生态环境质量和维护国家生态安全方面发挥了重要作用。对于黄河流域跨行政区的自然保护地,目前条块分割行政管理体制不利于自然保护地多重利益的实现,府际合作制度则能够弥补这种不足。在现有法律框架范围内,自然保护地府际合作制度在黄河流域的实施仍待加强。从法学的视角分析,黄河流域跨行政区自然保护地府际合作制度由三部分内容构成:实施机制的决策、执行与监督;法治协调机制的内部协调与外部协调;保障机制的信息共享与纠纷解决。这些机制的构建,需要与宪法、行政法基本理论相结合,促进自然保护地多重利益的实现。
<<Nature reserves in the Yellow River Basin are important ecological barriers in China. They play an important role in protecting biodiversity,preserving natural heritage,improving ecological environment quality and maintaining national ecological security. For the nature reserves across administrative regions in the Yellow River Basin,the current compartmentalized administrative management system is not conducive to the realization of multiple interests of nature reserves,while the inter-governmental cooperation system can make up for this deficiency. Within the existing legal framework,the implementation of inter-governmental cooperation mechanism of nature reserves in the Yellow River Basin needs to be strengthened. From the perspective of law,the inter-governmental cooperation system of cross-administrative nature reserves in the Yellow River Basin consists of three parts:decision-making,implementation and supervision of the implementation mechanism;internal coordination and external coordination of the rule of law coordination mechanism;information sharing and dispute resolution of security mechanism. The construction of these mechanisms needs to be combined with the basic theories of constitution and administrative law to promote the realization of the protection interests of nature reserves.
