《长江保护法(草案)》提请审议拉开了单个流域立法的序幕,黄河特殊的经济、生态及文化历史地位决定了黄河保护立法势在必行。但如果仅“就河谈河”“就水谈水”,可能会出现黄河治理的表面化和浅层次性。黄河立法应该立足于考察自然时空和社会时空的交错对黄河治理的影响,坚持自然时空下的黄河水土保持和生态自然修复与社会时空下黄河水量的管控和水污染的防治两条主线交错并行,以多元协调治理作为沟通机制的双轨制立法模式,以确保黄河生态保护和高质量发展目标的实现。
<<The prelude to legislation for a single river basin was opened by the proposal of The Draft of the Yangtze River Protection Law. Due to its special ecological,cultural and historical status,the Yellow River protection legislation is imperative. However,if we only talk about rivers and water,the superficiality and shallowness of the Yellow River governance may occur. The legislation of the Yellow River should be based on the investigation of the impact of natural space-time and social space-time on the governance of the Yellow River. We should be adopted a dual-track legislative model in which the two main lines of the Yellow River’s legislative. They’re important of soil and water conservation and ecological restoration under natural space-time and the control of the Yellow River’s legislative water volume and the prevention and control of water pollution under social space-time. The two main lines are intertwined in order to ensure the realization of the goal of ecological protection and high-quality development of the Yellow River.
