There are some questions still need to be cleared up on the legislative protection ecological protection and high quality development of Yellow River Basin，and they are the essential and critical factors of legislative work conducting correctly. In establishing of guideline of legislation，lawmakers have to insist on this principle on systematic perspective，holistic view，scientific view，human-based thought and cooperative philosophy. In exploring of the sphere of application of legislation，they ought to think of Yellow River Basin as an integrated whole，and demarcate its boundary. They should also integrate elements of population，resource，economy and ecological environment with idea of space governance. Finally，combined with efforts，they can analyze subject，object，and the content of legal relation. In the aspect of confirmation of legal relations，lawmakers need to understand that environmental legal action is main thread of coupling elements of the nature and society，and it is also the key to filter and identify legal facts from complex social phenomenon. The basic approach is simplification and transformation for confirming legal relations of Yellow River basin society. Through the comparison and analysis of sample clauses of the yangtze river laws，we found that there were some disagreements about the above methods between the lawmakers and the scholars. It requires Yellow River that lawmakers are aware of limitation of Yangtze River draft law，meanwhile，they should learn from the useful experience.
