Firstly，this paper analyzes three cases of patent infringement，trade secret theft and cross-border standard necessary patent，and puts forward that the protection of intellectual property rights in the field of autonomous driving should not be ignored，while the comprehensive protection of intellectual property rights needs to be further improved. Secondly，the patent of autonomous driving technology has been retrieved for nearly 20 years through the database of incopat，and the trend of patent application，the geographical distribution of patent，the distribution of patent technology and the patentee have been analyzed to show the present situation of patent development in the auto-driving industry at home and abroad. Finally，in order to promote the protection of intellectual property rights of enterprises，this paper puts forward some policy suggestions such as formulating comprehensive protection strategy of intellectual property rights，strengthening the application of intellectual property rights，using patent layout to improve core competitiveness，from technology development to leading industry，and preempting the necessary patent opportunity of standard.
