近年来,各国不断加快对自动驾驶汽车产业的布局,产业变革之下,自动驾驶已然是大势所趋。世界各国也正在探索和完善自动驾驶领域的法律法规及相关标准以适应产业的快速发展。2017年12月29日,工信部、国家标准委联合出台了《国家车联网产业标准体系建设指南(智能网联汽车)(2017)》(以下简称《指南》),该文件的出台为我国自动驾驶汽车产业的发展指明了方向。《指南》提出,到2020年,能够初步建立支撑辅助驾驶及低级别自动驾驶的智能网联汽车标准体系,到2025年,系统形成能够支撑高级别自动驾驶的智能网联汽车标准体系。《指南》的颁布是为贯彻落实《中国制造2025》战略部署,加快推动我国智能网联汽车产业发展,发挥技术标准的引导和规范作用。但是,目前自动驾驶领域的诸多问题仍未在法律层面上得到解决,例如网络安全、数据安全以及事故责任问题等。本文拟从道路测试、自动驾驶地图测绘、保险以及交通事故处理等方面对我国自动驾驶法律法规进行梳理,并简要介绍、分析国外有关政策及法律法规动态。
<<In recent years,many countries have been accelerating the layout of the automated vehicles industry. Under the industrial transformation,automated vehicles have become the general trend. Various countries are also exploring and improving laws,regulations and related standards in the field of automated vehicles to adapt to the rapid development of the industry. On December 29th,2017,the Ministry of Industry and Information Technology and the National Standard Committee jointly promulgated the Guidelines for the Construction of Standard System of National Automotive Networking Industry (hereinafter referred to as the Guidelines),which pointed out the direction for the development of China’s automobile industry. The Guidelines proposes that by 2020,a standard system for intelligent connected vehicles supporting assisted driving and low-level automated vehicles will be initially established,and by 2025,a standard system for smart networked automobiles supporting high-level automated vehicles will be formed. The purpose of promulgation of the Guidelines is to implement the strategic deployment of Made in China 2025,accelerate the development of China’s intelligent connected vehicles industry,and play the role of guiding and standardizing technical standards. However,at present,many problems in the field of automated vehicles have not been solved in the legal aspect,such as network security,data security and accident liability. This article states the laws and regulations of automated vehicles in China from the aspects of road test,automated vehicles map mapping,insurance and traffic accident handling,and briefly introduces the relevant foreign policies and laws and regulations.
