随着国际社会对北方海航道和西北航道重视程度的大幅上升,这两条海上通道在适用《联合国海洋法公约》规定的通行制度和“冰封区域”条款时的争议日益突出。对《联合国海洋法公约》的解释和适用存在不同意见,是引起北极航道问题的重要原因。尽管相关争议焦点是法律问题,然而国际政治的现实远比法律本身复杂。合理运用《联合国海洋法公约》并树立针对北极航道争议的底线思维,进而在此基础上进行灵活调整,应是中国制定相关政策的总体思路。中国可主张北方海航道和西北航道是国际海峡,并从有利于维护航行权益的角度对《联合国海洋法公约》第234条进行解释。同时,中国也需在不突破底线的基础上,根据国际情势对政策作出适当调整。
<<As the international community pays more attention to the North Sea Route and the Northwest Passage,the disputes concerning the interpretation or application of passage regime and article 234 of the UNCLOS become much more prominent. There are different opinions on the interpretation and application of the those clauses,which is an important cause of the disputes. Although the focus of the problems are on legal issues,the reality of international politics is far more complicated than the law itself. The rational use of the Convention and the establishment of the bottom line of thinking about the Arctic passage disputes,and then to make flexible adjustments on this basis,should be China’s overall policy for formulating relevant policies. China may claim that the Northern Sea Route and the Northwest Passage are international straits and interpret Article 234 of the Convention from the perspective of protecting the rights and interests of navigation. At the same time,China also needs to make appropriate policy adjustments based on the international situation without breaking through the bottom line.
