气候、生态,以及社会经济的变化对北极地区的渔业法律秩序产生了显著影响。《预防中北冰洋不管制公海渔业协定》于2017年正式通过,2018年该协定的缔约方全体签署。2019年缔约方中的俄罗斯、欧盟、加拿大、日本、美国、韩国陆续批准了该协定。通过对该协定的新动态进行实证研究与规范研究可知,《预防中北冰洋不管制公海渔业协定》有较大可能于2020年得到全部缔约方的批准,从而正式生效,全面禁止北冰洋中部公海区域的商业捕捞活动。并且,在已经批准该协定的6个缔约方中,各缔约方批准的决定均符合其本国或组织当前北极政策的发展趋势和参与北极公海渔业治理的立场。对中国而言,可积极参与《预防中北冰洋不管制公海渔业协定》的落实,加强与北极国家及利益攸关方在北极渔业问题上的合作,强调依据国际法中国所享有的相关权利义务,推进建立北冰洋公海渔业管理组织的进程,并不断强化中国参与北极渔业治理的政策支持与能力建设以应对该协定新动态所带来积极影响和消极影响。
<<Climate,ecology,and social-economic changes have had a significant impact on the fishery legal order in the Arctic. “Agreement to Prevent Unregulated High Seas Fisheries in the Central Arctic Ocean” was passed in 2017,and signed in 2018. In the year of 2019,Russia,the European Union,Canada,Japan,the United States,and South Korea have ratified the agreement one after another. After making empirical and normative research on the new developments of the agreement,the results shows that the agreement is likely to be ratified by all parties in 2020,which will officially enter into force and ban commercial fishing activities in the high seas of the central Arctic Ocean. Besides,of the six parties that have ratified the agreement,the decisions approved by each party are consistent with the current trends in the Arctic policy of their own countries or organizations and are also consistent with their positions in participating in the governance of Arctic fisheries. In response to the positive and negative effects of the six parties’ new development,China can actively participate in the implementation of the Agreement,strengthen cooperation with Arctic countries and stakeholders on the issue of Arctic fisheries,emphasize the relevant rights and obligations enjoyed by China in accordance with international law,promote the establishment of Arctic Ocean high seas fisheries management organizations process,and continue to strengthen China’s policy support and capacity building to participate in the governance of Arctic fisheries.
