2019年3月5日,李克强总理在《政府工作报告》中提出,2019年高职院校扩招100万人。从党的十一届三中全会至今,我国的高等职业教育法治建设可以分为政策支持、立法保障、全面依法治教三个阶段,逐步形成我国高等职业教育发展的法律体系。采用历史研究和走访调研的方法,从法治的视角审视和研究职业教育扩招。在全面依法治国、全面依法治教的要求下,高等职业教育还存在配套政策不完善、法律实施不充分、办学主体法治思维和依法办学的能力未普遍形成等问题。应加强立法,形成与全面依法治教相适应的法律政策体系,提升办学主体的法治思维和依法办学能力,形成与依法办学相适应的学校管理体系,注重依法办学的宣传,形成依法办学的浓厚氛围等,加强高等职业教育全面依法治教建设,从而为高等职业教育质量型扩招提供坚强法治保障。
<<On March 5,2019,Premier Li Keqiang proposed in the “Government Work Report” that the enrollment of higher vocational colleges will increase by 1 million in 2019. Since the Third Plenary Session of the Eleventh Central Committee of the Communist Party of China,the construction of rule of law in China’s higher vocational education can be divided into three stages:policy support,legislative guarantee and comprehensive administration of education according to law,gradually forming a legal system for the development of China’s higher vocational education. Using the methods of historical research and visiting investigation,this paper examines and studies the enrollment expansion of vocational education from the perspective of rule of law. Under the requirements of comprehensively administering the country and teaching according to law,there are still some problems in higher vocational education,such as imperfect supporting policies,inadequate implementation of laws,and the failure to form the legal thinking and the ability to handle affairs according to law. Therefore,we should strengthen legislation,form a legal policy system suitable for comprehensively administering education according to law,enhance the legal thinking and ability of running schools according to law,form a school management system suitable for running schools according to law,pay attention to the publicity of running schools according to law,form a strong atmosphere of running schools according to law,etc.,and strengthen the construction of comprehensively administering education according to law in higher vocational education,thus providing a strong legal guarantee for the quality-oriented enrollment expansion of higher vocational education.
