物业管理作为一种专业化、市场化、现代化的房屋管理模式,对提升城市居民的居住环境和房产的增值、保值具有重要意义,但由于我国物业管理发展时间有限和市场竞争不足,物业管理企业服务水平参差不齐,物业投诉率居高不下,基层法院受理的物业服务合同纠纷案件呈暴发式增长态势。本报告从近年来物业服务合同纠纷争议的十大焦点出发,分析我国物业管理中存在的业主认识误区、物业服务公司身份模糊和服务质量有待提高等不足之处,指出法院所希望的ADR纠纷解决方式并不能充分解决现实的争议,唯有法律条文的细化和对权利、义务、职责的明确,才可以让我国的物业服务走向市场化。
<<as a specialized,market-oriented and modern housing management mode,property management is of great significance to improve the living environment of urban residents and the value-added and maintenance of real estate. However,due to the limited development time of property management and the lack of market competition in China,the service level of property management enterprises is uneven,and the property complaints rank first,and the property services accepted by the grass-roots courts are combined. The number of the same dispute cases is increasing in an explosive way. Starting from the ten focuses of disputes over property service contracts in recent years,the report analyzes the misunderstanding of property owners,the vague identity of property service companies and the lack of service quality in property management in China,and points out that the ADR dispute resolution method that the court hopes can not fully solve the actual disputes. In order to make our property service market-oriented road,only the refinement of legal provisions and the clear definition of rights,obligations and responsibilities can.
