作为城市更新活动中的两大主体,政府是公共利益维护者,市场是私人利益的追求者,利益和角色的不同决定了二者的关系不可避免会出现冲突和错位。深圳市城市更新政策在协调政府和市场的关系、实现双方利益平衡的过程中实现了自身价值的升华,其外化表现为:为解决市场失灵,政府从“不积极干预”到“谦抑干预”的转变。在法治范畴考量深圳城市更新政策,它应有一个向法律转型的路径:一方面,对现有政策进行整合和类型化,为政策的法律化奠定基础;另一方面,加快特区城市更新基本法的出台,指导政府和市场依法参与城市更新活动。当然,随着政府介入的程度越来越深,应警惕政府过度干预而限制市场更新改造的积极性,通过法律规范政府权力的运行。
