In view of the important status of criminal justice in the judicial system and the importance of human rights protection in criminal justice, the issue of human rights protection in criminal justice should be an important component of human rights protection research. China's judicial organs do not have the power to directly apply judicial solutions to specific cases. In this sense, it is impossible for the judiciary to use the basic human rights stipulated in the Constitution as the basis for its trial. Therefore, the protection of human rights in the criminal justice process, or the reflection of the human rights protection system and value of the Constitution in the criminal justice, needs to be transformed by legislation, and only those rights included in the scope of legal protection may be protected by the judicial organs. Therefore, the research on the protection of human rights in the process of criminal justice needs to be carried out from the perspective of the protection of the rights of the parties, other litigants and special subjects.
