北京近五年网络虚假信息案件数位列全国第三,网络虚假信息传播已亟须刑法规制,应加强网络虚假信息传播刑法边界的理论研究,纠正实践中习以为常却是错误的做法。坚持罪行法定与从旧兼从轻原则,适用修正后的刑法来界定“虚假信息”范围,针对虚假的险情、疫情、灾情、警情4种情形之外的信息,即使内容虚假,也不得认定为刑法上的虚假信息。将网络诽谤作为自诉案件会导致对该类行为处罚不力、规制失效。实践中办案常常达不到此类案件的证据标准,导致部分行为逃脱刑事处罚。
<<In recent five years,Beijing has ranked the third in the number of cases of false information on the Internet in China. The dissemination of false information on the Internet is in urgent need of criminal law regulation. We should strengthen the theoretical research on the criminal law boundary of false information dissemination on the Internet,and correct the practices that are used to but wrong in practice. The scope of “false information” should be defined by applying the revised criminal law. Even if the content of false information is not true,it should not be regarded as false information in criminal law. Taking Internet defamation as a case of private prosecution will lead to ineffective punishment and ineffective regulation. In practice,the handling of cases often fails to meet the evidence standard of such cases,leading to some behaviors escaping criminal punishment.
