    营商环境法治化建设的中国实践

    摘要

    2019年是中国营商环境法治化建设的开局之年。中国采取了以评估促建设的方式,主动对标世界银行的营商环境评估,同时大力发展政府的营商环境评价和各类第三方评估。这些评估精确地诊断了相关问题,提供了强大的建设动力,改变了营商环境面貌。中国营商环境法治化建设体现在四个领域:立法、行政、司法和社会。中国大力推动营商环境法律规范的立、改、废工作,形成了以行政法规和地方性法规为主导的规范体系。中国政府开展了以评估指标为导向的改革,创建了更为高效、便利、透明、民主的行政机制。司法机构破解了执行难题,以专业审判、信息化和司法解释等方式保障营商环境。社会的参与和监督机制也广泛建立。

    Abstract

    The year 2019 is the first year of building a law-based business of environment in China. In this year,China adopted the method of promoting the building of business environment through assessment,applied the World Bank Doing Business Index to carry out assessment,and vigorously developed government business environment assessment and various third-party assessments. These assessments have accurately diagnosed the relevant problems,provided strong motive for construction,and effectively changed the features of business environment. The building of law-based business environment in China is carried out in the following four fields:legislation,administration,justice and society. China has vigorously advanced the making,revision,and abolition of laws and administrative regulations on business environment,developed a normative system with administrative regulations and local regulations as the main body,and carried out assessment index-oriented administrative reform and established a more efficient,convenient,transparent,and democratic administrative mechanism. Judicial organs have overcome the difficulties in enforcement,and safeguarded business environment with professional trial,informatization,and judicial interpretation. Mechanisms for social participation and supervision have also been extensively established.
