    北京市现有民办学校分类登记的实施程序与制度衔接:反思与建构

    摘要

    北京市出台了民办教育“1+2”配套文件,下一步将会出台“北京市现有民办学校变更法人登记类型管理办法”,将现有民办学校的分类登记实施程序与相关的制度衔接进一步明确。北京市颁布的民办教育“1+2”配套政策解决了北京市民办教育发展的方向性问题,对实践中的关键问题回应力度不够,主要表现为各类资产的认定和处理方式不明确、审批机关和登记机关对办学资质要求不一、办学许可证与法人登记联系不紧密;建议北京市根据地方实际,结合首都功能定位,细化各类资产的认定和处理方式、加强对办学条件和举办者资质的预先审查、完善证照衔接的制度设计、积极发挥民办教育联席会议制度的整合作用。

    Abstract

    Beijing has issued “1+2” supporting documents for private education,and the next step will issue the administrative measures for the change of type of existing private schools in Beijing,which will further clarify the connection between the implementation procedures of classification registration of existing private schools. The policy of “1 + 2” issued by Beijing solves the problem of the direction of the development of private education in Beijing and the response to the key problems in practice is not enough. It is unclear to make various assets,the different requirements of the examination and approval authorities and the registration authorities for the qualification of the school,and the lack of close connection between the school license and the legal person registration. It is suggested that Beijing should,according to the local conditions and in combination with the functional orientation of the capital,refine the identification and treatment of various assets,strengthen the pre examination of school running conditions and the qualifications of the organizers,improve the system design of the connection of certificates and licenses,and give full play to the integration and cooperation of the joint conference system of private education.
