《重庆市公共体育场馆条例》颁布于1999年,仅经过2005年一次修订,本文基于实地走访、问卷调查等形式,通过构建“总则、规划与建设、运营与管理、使用与维护、法律监督与法律责任”的立法框架模式,主要提出了以下问题和修改建议。首先,在总则部分,缺乏对公共体育场馆的定义、立法目的、基本原则的规定,应当予以明确。其次,在规划与建设部分,存在人均公共体育场馆面积分布失衡、场馆的建设重大轻小、资金来源较为单一等问题,建议立法落实城乡体育事业均衡发展、重视中小型公共体育场馆的建立和完善,同时通过创新性融资等方式增加建设资金的来源。再次,在运营与管理部分,应强调公共体育场馆所有权与运营权相分离,并明确公共体育场馆运营模式的多样化。复次,在使用与维护部分,立法关于场馆开放时间和开放公示的规定未适应上位法的要求,同时,场馆维护经费及维护人员等缺乏规范,建议建立“公共体育场馆发展基金”,同时可考虑采取聘用制的方式聘用维护人员开展维护工作。最后,在法律监督与法律责任部分,相关规定过于薄弱,一是法律监督主体单一,应建立由多元主体构成的监督体系;二是法律责任的重要性未能凸显,影响法律实施的效果,应对法律责任进行精细化、科学化规定。
<<The Regulations of Chongqing Public Stadiums and Gymnasiums was promulgated in 1999. It was only revised in 2005. Based on field visits,questionnaires and other forms,through the construction of the legislative framework model of “General Principles,Planning and Construction,Operation and Management,Use and Maintenance,Legal Supervision and Legal Liability”,this paper mainly proposes the following problems and suggestions for revision. First of all,in the general part,the lack of definition of public stadiums and gymnasiums,legislative purposes,basic principles should be clearly defined. Secondly,in the planning and construction part,there are some problems,such as unbalanced distribution of per capita public stadiums and gymnasiums,small and significant construction of stadiums and gymnasiums,single source of funds and so on. It is recommended that the legislation implement the balanced development of urban and rural sports,attach importance to the establishment and improvement of small and medium-sized public stadiums and gymnasiums,and increase the source of construction funds through innovative financing. In terms of operations and management,it should be emphasized that the ownership and operation rights of public stadiums and gymnasiums are separated and make clear the diversification of operation modes of public stadiums and gymnasiums. Thirdly,in terms of use and maintenance,the legislative provisions on opening time and opening publicity of stadiums and gymnasiums do not meet the requirements of the Superior Law. At the same time,there is a lack of standardization in funds for maintenance of stadiums and gymnasiums and maintenance personnel. It is suggested that a “development fund for public stadiums and gymnasiums” should be established. At the same time,the employment system should be considered to hire maintenance personnel for maintenance work. Finally,in terms of legal supervision and legal liability,the relevant provisions are too weak. First,the subject of legal supervision is single,and a supervision system composed of multiple subjects should be established. Second,the importance of legal liability has not been highlighted,affecting the effect of law implementation,and the legal liability should be elaborated and scientifically stipulated.
