The proper situation of local environmental protection legislation can provide authority positioning，mode positioning and value positioning for in-depth analysis of its actual state. With the help of empirical analysis tools，taking Yunnan Province as a sample，the actual state of local environmental protection legislation is presented through a macro perspective and a micro perspective. Through comparison，it shows the accordance and the separation between the ideal positioning and the actual state，which can show the bottleneck of local environmental protection legislation：in the macro perspective，the characteristics and the shortcomings coexist；in the micro perspective，the insufficiency of the mode operation and the the short board needing to be complemented coexist. Therefore，it is necessary to break through the existing barriers of local environmental protection legislation through mode optimization，short-board complementation and orientation conversion.
