1930年巴西工人组织发展初期即无政府工团出现以来,巴西劳工法和劳动关系经历了社团主义、工人组织立法发展、工会统一化发展、劳工法改革等不同发展阶段。其中,特梅尔执政时期(2016~2018年),政府进行的劳工法改革存在一些违背宪法之处,严重地损害了劳动者的利益,雇主的利益公开地凌驾于劳动者的利益之上。另外,我们仍然不能忽视司法部门在解决个人和集体劳动争议方面的重要作用。2019年博索纳罗新政府上台以后,巴西工薪阶层的前景并不乐观。
<<This paper reviews the historical process of the evolution of Brazilian labor law and labor relations since 1930. On this basis,it examines the labor law reform and labor relations of the Temer government and the new government of Bolsonaro and reveals the role of the judiciary in the reform of the labor law and its impact on labor relation. It is believed that the labor law reform during the Temer government severely damaged the interests of workers. The interests of the employers are publicly above the workers,and in the new government of Bolsonaro,the prospects of the working class are not optimistic. There are some violations of the constitution in Brazil’s current labor law reforms,but the important role of the judiciary in resolving individual and collective labor disputes cannot be ignored.
