2018年,虽然网络空间国际经贸活动迅猛增加,然而互联网经贸规则法治化治理机制的发展却相对迟缓。当前,各网络大国开始以数字贸易为方向深化区域层面的经贸合作,以安全审查制度为工具限制互联网行业的海外投资,并以控制者标准为基础拓展数据治理的管辖范围。实践中,由于互联网经贸治理机制碎片化、主要网络大国立场分歧难以消弭、互联网经贸单边主义抬头,互联网经贸规则法治化治理机制正面临挑战。作为负责任的网络大国,我国宜倡导以WTO改革为契机解决数字贸易议题,以升级中国区域贸易协定与双边投资协定的方式推动企业走出去,以系统完善我国互联网经贸治理机制为基础推广中国经验,并以推进我国法域外适用的法律体系建设为起点维护我国正当利益。
<<Due to the fragmentation of the internet economic governance and the divergences among great powers,as well as the rise of the unilateralism globally,the rule of law mechanism in cyberspace is facing challenges. As a responsible nation,China should regard WTO reform as an opportunity to negotiate digital trade issues,and upgrade China’s regional trade agreements and bilateral investment agreements to encourage investment aboard. Additionally,China could introduce the experience of internet regulation around the globe,and extend the legitimate jurisdiction,in order to safeguard citizens’ interest.
