本报告立足审判人力资源配置与司法正义实现问题,采取实证研究和比较研究相结合的方法,通过对影响司法正义实现的审判人力成本投入及资源配置方式的分析研究,提出优化西部法院审判人力资源配置,解决审判人力资源与司法需求矛盾冲突的方法。以指定管辖建立符合城乡二元结构的审判人力资源配置制度;以院校合作等多种方式解决法官助理难题;以制度管理建设为着力点,建立审判人力资源配置效益制度,重构法院内设机构,设置大审判委员会、法院行政管理局、审判事务管理局、院长助理办公室,实施审判事务与司法行政事务分离、法官与司法行政人员分离制度,科学划分各类人员工作职责,实施法院人员分类管理;适当延长法官退休年龄,使资深法官资源得到更有效利用。
<<This report is about the problems of human resources allocation in courts and the realization of judicial justice. It combines empirical research with comparative research. Through the analysis and research of labor cost input and resource allocation methods in courts that affect the realization of judicial justice,it proposes methods to optimize the allocation of human resources in courts in the western region and solve the conflicts between human resources and judicial needs,i.e. establishing human resources allocation system that conforms to the urban-rural dual structure with designated jurisdictions;solving the problems judges face by means of cooperation between courts and colleges;establishing a system of efficiency in the allocation of human resources in courts with the focus on institutional management;reconstructing the internal organs of the court,setting up the grand judicial Committee,the court administrative authority,the judicial affairs authority and assistant president’s office;separating of judicial affairs and judicial administrative affairs and of judges and judicial administrative personnel;classifying the duties of various personnel,implementing the classified management of court personnel;and appropriately extending retirement age of judges to make more effective use of senior judges’ expertise.
