With the development of society，agricultural intellectual property rights are of great significance to the development of agriculture. Henan Province has made certain achievements in promoting the development and protection of agricultural intellectual property rights，but there are still problems such as insufficient legal awareness，inadequate legal system，imperfect management system，poor use of agricultural intellectual property，insufficient talents，and insufficient incentives. In response to the problems existing in the development of agricultural intellectual property in Henan Province，corresponding suggestions were put forward.
