法律援助制度的发展与完善,是党的三中、四中全会提出的重要改革任务之一,更与认罪认罚制度等一系列重要司法改革的实现相辅相成。为了让法律援助制度迈向新的台阶,就必须满足经费保障的先决要求。但经费总量不足、案均经费远低于发达国家水平、各地经费不均衡不充分等问题,直接制约着律师办理案件的积极性,更进一步影响了案件的承办质量。保障刑事法律援助的工作质量,应立足我国司法实践现状,回应现实中经费保障带来的现实问题。为此,我国将面临两条可选路径:其一,加大中央—省级财政的保障力度,逐步缩小法律援助制度的地区差异;其二,根据法律援助性质,重新规划法律援助的经费保障体系。
<<The development and improvement of the legal aid system is the major task proposed at the third and fourth plenary session of the 18th CPC Central Committee. It also closely connected to the System for Imposing Lenient Punishments on Those confessing to Their Crimes and Accepting Punishments in Criminal Cases. The fund guarantee mechanism is the most significant thing in order to bring the legal aid system to a new level. However,the funds allocated to each case and each province is insufficient and inadequate,which lead to the low willingness among lawyers in handling legal aid cases,and further impair the quality of services provided. Therefore,in order to solve these problems,there are two possible ways. On one hand,minimizing the regional difference by strengthen the role of financial support. On the other hand,reorganize the fund guarantee mechanism in accordance with the nature of legal aid.
