20世纪60年代开始,非洲各国纷纷独立,与此同时,环境权被西方社会提出,环境权入宪成为国际社会最热点的问题。在殖民资源掠夺、非洲环境危机和西方法律移植的背景下,《非洲人权和民族权宪章》首次在区域性人权公约中提出环境权保护。1990年贝宁成为第一个环境权入宪的非洲国家。经历三次入宪浪潮,至今共33个非洲国家在宪法中写入了公民环境权,非洲成为全球环境权入宪的主力军,这些国家尤以非洲大陆法系国家居多。多元化的条款设计与差异化的实施效果,让非洲宪法环境权研究颇具价值。从宣示性的单一型条款,到公民权利义务结合国家责任与司法救济的综合型条款,非洲各国对公民环境权保护与救济的法律制度日益完备,对程序性环境权的保障也趋于严格。基于文本比较与实效分析,环境权入宪并非解决非洲环境危机的决定性因素。是否在法律中赋予作为公民基本权利的环境权以可诉性,才是保障公民环境权,救济实体性权利与程序性权利,以及促进环境公益诉讼的关键所在。
<<Since the 1960s,African countries have become independent gradually.At the same time,environmental rights have been put forward by the western society,and the constitutionalization of environmental rights has become the hottest issue in the international community.In the context of colonial resource plunder,African environmental crisis and western legal transplant,the African Charter on Human and Peoples' Rights proposed the protection of environmental rights in regional human rights conventions for the first time.Benin became the first African country to have environmental rights enshrined in its constitution in 1990.After three waves of constitutional inclusion,33 African countries have so far included citizens' environmental rights in their constitutions,and Africa becoming the main force for the inclusion of global environmental rights into the constitution,especially African continental law system countries in the majority.The design of diversified articles and the implementation effect of differentiation make the study of African constitutional environmental rights of great value.From declarative clauses to comprehensive clauses that combine civil rights and obligations with state responsibilities and judicial relief,African countries have increasingly complete legal systems for the protection and relief of citizens' environmental rights and stricter protection of procedural environmental rights.Based on textual comparison and practical analysis,the inclusion of environmental rights in the constitution is not the decisive factor to solve the environmental crisis in Africa.The key lies in whether citizens' environmental rights can be litigated in law.
