In recent years，with the development of the Internet+，e-commerce has shown a rapid burst of growth. The food take-out industry based on e-commerce platforms has become increasingly prosperous. The number of users of e-commerce platforms and the frequency of platform use have increased year by year. Online food orders，offline food delivery，food and beverage broke the traditional geographical and space-time restrictions，which also raised difficulties for food safety protection. Faced with the new problem of food safety in e-commerce platforms，we have some of National legislations to guide the regulation of food safety in e-commerce platforms. In Henan province，the local legislation on the safety of e-commerce takeaway food is not quick enough and the achievements are still very few. Some local laws and regulations suitable for local implementation need to be promulgated，so as to regulate and guide the e-commerce takeaway food market in Henan province more precisely.
