    中国劳动法治四十年

    摘要

    1978年中国实行改革开放政策以来,中国劳动法治不断完善。劳动法治经历了探索、初创和完善三个阶段。在此期间,中国初步形成中国特色劳动法律体系,劳动监察行政执法不断加强,劳动争议处理制度不断完善。未来,中国应完善法律调整机制、健全劳动法律体系,加强劳动行政执法、提高执法监督水平,完善劳动争议处理机制,促进劳动法制统一。

    Abstract

    Since the implementation of the policy of reform and opening-up in 1978,China has been continuously improving its labor law system,which has experienced three stages of development:exploration,initial construction and improvement. In this process,a labor law system with Chinese characteristics has taken initial form,labor supervision law enforcement has been increasingly strengthened,and the labor dispute resolution mechanism has been continuously improved. In the future,China should further improve the legal mechanism for the adjustment of legal relations and the labor law system,strengthen labor administrative law enforcement,raise the level of supervision over labor law enforcement,and promote the unity of the labor law system.
