人民法院“基本解决执行难”工作开展以来,全国法院执行工作取得了显著成效,执行大格局筑基成形,执行力量大幅增强,执行规范化水平明显提升,执行信息化建设再上新台阶。为实现党的十八届四中全会提出的“切实解决执行难”目标,下一步必须着眼于制度建设,推进民事强制执行立法,完善包括个人破产在内的破产制度,大力加强社会信用体系建设,丰富完善社会救助体系。在此框架下,巩固人民法院三年“基本解决执行难”工作成果,紧紧依靠党的领导,在全面依法治国框架下全面依法治理“执行难”,在综合治理执行难工作大格局中持续优化联动机制;强化立审执破衔接,定分止争,充分告诫拒不履行的法律后果,减少进入强制执行程序案件,畅通执行案件退出通道;强化执行强制性、规范性,在依法刚性地惩戒拖延、逃避、抗拒执行行为的前提下不间断推进执行程序,使案件得到全面有力的执行,最终形成“自觉履行为主,强制执行为辅”大格局,努力让人民群众在每一个司法案件中感受到公平正义。
<<Since the work of basically solving difficulties in judicial enforcement was carried out,courts at all levels have achieved remarkable results in enforcement field. The general execution pattern has been shaped,the execution force has been greatly enhanced,the level of execution standardization has been significantly improved,and the informatization of judicial enforcement has reached a new level. In order to achieve the goal of effective solving difficulties in execution put forward by the 4th Plenary Session of the 18th Central Committee of the CPC,great efforts should be made to develop system,build a long-term mechanism,and comprehensively overcome difficulties in judicial enforcement in accordance with the law under the framework of comprehensive rule of law. We should continue to promote the legislation of compulsory execution,so as to strengthen the foundation of execution;constantly improve the bankruptcy system and establish a suitable mechanism for those judgements which cannot be enforced;vigorously construct the social credit system and increase sanctions for credit defaulters;and continue to improve the social assistance system to solve the problems of execution concerning people's livelihoods. On the basis of the effectiveness of the work of basically solving difficulties in judicial enforcement,courts all over China should constantly consolidate the basis of effectively solving difficulties in judicial enforcement and strive to make the people feel fairness and justice in every judicial case.
