随着我国经济文化一体化进程逐步加快,非物质文化遗产的社会价值和经济价值日渐凸显,通过法律手段保护非遗已是世界范围内公认的最为稳定有效的保护方式。经过多年努力,我国在非遗法律保护领域成效显著,形成了由我国加入的国际公约、非遗专门法律、国务院制定的行政法规、各部委制定的部委规章以及地方性法规组成的法律法规体系,并积累了法律保护经验,但在具体的少数民族非遗法律保护实践中,也存在着与国际公约对接的法律法规欠缺、民族自治地区立法工作有待加强等问题。本报告立足少数民族非遗保护与传承实际,提出未来我国应认真履行国际公约及借鉴国外非遗法律保护的经验,明确少数民族非遗保护的法律渊源,依托民族自治确立少数民族非遗法律保护模式,注重加强民族自治地方立法工作的稳步推进,健全从立法、执法到守法的少数民族非遗法律保护体系,以期为少数民族非遗的保护与传承提供强有力的法治保障。
<<The value of intangible cultural heritage is more accessible than before in the background of global rapid economic and social development. Legislation is universally recognized as the most effective means to safeguard the intangible culture. Without exception,China has improved its legal system regarding the intangible cultural heritage because of many years’ efforts. This system is composed of the international conventions into which China accesses,the specific laws,the administrative regulations enacted by the State Council,the regulations enacted by the relevant ministries and departments of the State Council,and the regulations and rules enacted by the local governments. Nevertheless,there are still some problems calling for attentions such as the shortage of the laws or regulations bridging international conventions and the local regulations,and the need to strengthen the legislation of autonomous regions of ethnic minorities. For this consideration,the present report focuses on the legislative protection and inheritance of the intangible cultural heritage of ethnic minorities. It claims that China should thoroughly fulfill the international conventions and learn the lessons of foreign countries. The source of the legislative protection of the intangible cultural heritage also should be clarified. Besides,the legislation of ethnic minorities’ autonomous regions should be improved in order to formulate a protection model within the realm of China’s national regional autonomy system. In nutshell,unless the legal system including legislation,enforcement and abiding is improved,it cannot provide legal protection of the intangible cultural heritage.
